These Terms of Service (“Terms”) govern your access to and use of this website and all digital content, materials, features, and services made available through it.

This website is operated by Design & Interliving LLC, a limited liability company. The business operates under the brand name Kitchen Design NYC. References to “we,” “us,” “our,” or the “Company” refer to Design & Interliving LLC.
By accessing or using this website, submitting information through any form, requesting information or pricing, downloading materials, or engaging with any digital service offered through this website, you acknowledge that you have read, understood, and agreed to comply and are bound by these Terms, Affiliate Disclosure and our Privacy Policy.
If you do not agree to these Terms, you must discontinue use of the website and all related services. The use of www.kitchen-design-nyc.com is governed by the terms provided herein:

1. Scope of These Terms
These Terms apply exclusively to the use of this website and to the digital and informational services made available through it. This includes general website access, blog and editorial content, educational materials and downloads, the Discovery Room and Virtual Showroom, facilitation services provided through those tools, virtual design services, and requests for Intro Calls or Clarity Calls submitted through the website.
These Terms govern only the website and the digital services described above. They do not apply to full kitchen design services or in-person design services. Any such services are governed solely by separate written agreements, which are independent from these Terms and are provided only if and when those services are formally proposed, quoted, and accepted by the user.
Nothing in these Terms should be interpreted as creating, extending, or implying any rights, obligations, or expectations related to full kitchen design or in-person services.

2. General Website Content and Informational Use
The website contains various forms of general content intended to explain services, share knowledge, and provide orientation. All general website content is provided for informational purposes only.

General website content is not project-specific and does not account for individual site conditions, budgets, regulations, technical constraints, or execution requirements. It does not constitute professional advice and does not create a designer-client, architect-client, contractor-client, or advisory relationship of any kind.

No duty of care arises from the use of general website content. Any decisions made based on such content are made at the user’s own discretion and risk.

2.1 Blog and Editorial Content
Blog posts and editorial content are intended to share general insights, educational information, and professional observations. This content is not tailored to any individual project and is not intended to address specific conditions, constraints, or requirements.
Blog and editorial content does not replace professional guidance from licensed architects, interior designers, engineers, general contractors, or other qualified professionals. Any examples, scenarios, layouts, processes, or cost discussions included in blog or editorial content are illustrative only.
Users are responsible for independently verifying all information and for consulting qualified professionals before acting on any information presented in blog or editorial content.

2.2 Educational Content, Downloads, Tools, and Guides
The website may provide access to educational materials such as guides, PDFs, worksheets, checklists, calculators, templates, and other tools. These materials are provided for general educational and orientation purposes only.
Such materials are not project-specific and do not reflect verified measurements, site conditions, building codes, regulatory requirements, or execution constraints. They do not constitute professional advice and do not replace the services of licensed or qualified professionals.
Any calculations, examples, diagrams, or cost references included in these materials are illustrative and non-binding. Use of these materials is entirely at the user’s own risk.
2.3 Individual Website Pages and Service Descriptions
Individual website pages, including pages describing services, processes, methodologies, positioning, or examples of work, are intended to explain offerings, clarify scope, and help users understand how the Company may be able to assist.
All information presented on such pages is provided for informational purposes only. Descriptions of services, processes, or outcomes do not constitute guarantees, representations, or binding commitments and do not create any obligation to provide services.
Any references to workflows, examples, cost considerations, timelines, or outcomes are illustrative only and may not reflect the circumstances of a specific project. Users are responsible for independently verifying all information and for consulting qualified professionals before relying on any information presented on individual website pages.
No duty of care arises from the use of individual website pages. Any decisions made based on such content are made at the user’s own discretion and risk.

3. Discovery Room and Virtual Showroom
The Discovery Room and Virtual Showroom are provided to support early-stage discovery, product exploration, and contextual orientation around cabinetry options and relative cost positioning. These tools are intended to help users explore possibilities, compare configurations, and request project-specific pricing from independent third-party providers.

The Discovery Room and Virtual Showroom are informational and facilitative in nature. They do not function as a sales platform, do not constitute a binding offer, and are not a substitute for professional planning, technical evaluation, or construction services.

3.1 Display Pricing in the Discovery Room
Any pricing shown for displays in the Discovery Room or Virtual Showroom reflects cabinetry-related product costs only for the specific display configuration presented. Such pricing reflects conditions at the time the display was created and may no longer be current.

Displayed pricing applies only to the configuration shown and does not automatically translate to other layouts, spaces, or projects. The scope included in any displayed pricing is limited strictly to what is explicitly stated as included.

Displayed pricing does not represent the total cost of a kitchen renovation. Unless explicitly stated otherwise, displayed pricing excludes construction labor, demolition, electrical work, plumbing, ventilation, structural modifications, permits, inspections, installation, project management, appliances, and any other costs that may arise during a renovation project.

The Company does not guarantee that pricing shown in the Discovery Room or Virtual Showroom is accurate, complete, or up to date and assumes no responsibility for reliance on such pricing.
3.2 Project-Specific Pricing Requests
When a user submits a pricing request for their own space through the Discovery Room or Virtual Showroom, the request is transmitted to the independent third-party provider associated with the specific display or brand from which the quote is requested. That third-party provider, acting as the cabinet fabricator or authorized representative of the displayed product, prepares and issues the project-specific quotation directly to the user.

The Company does not prepare, calculate, verify, or issue project-specific pricing. All quotations are created and provided solely by the independent third-party provider, based on the information available to them and their own evaluation and pricing methodology.

When reviewing any project-specific quotation, users should be aware that such pricing reflects cabinetry-related product costs only, unless the quotation explicitly states otherwise in writing. Only the scope clearly and expressly identified in the quotation is included. All other renovation-related costs are excluded unless specifically listed.

Project-specific pricing does not represent total project or renovation cost. True and complete project costs can only be determined by the relevant third-party providers following professional evaluation of the specific project conditions, site constraints, technical requirements, and execution scope.

3.2.1 Facilitation Services
Facilitation services are provided exclusively through the Discovery Room and Virtual Showroom. Facilitation consists solely of transmitting user-submitted information and enabling introductions between users and independent third-party providers for the purpose of obtaining pricing or product information.

Facilitation services are provided free of charge and are initiated at the user’s request. They do not constitute sales, brokerage, agency, representation, or endorsement of any third-party product or provider.
The Company does not participate in pricing decisions, negotiations, or contractual arrangements between users and third parties and is not a party to any agreement entered into between a user and a third-party provider.

3.2.2 Consent to Third-Party Contact
By submitting a request for pricing or a quote through the Discovery Room or Virtual Showroom, the user expressly consents to the sharing of their contact and project-related information with relevant third-party providers solely for the purpose of fulfilling that request.

Such contact is necessary for third-party providers to evaluate the project and prepare pricing. Submission of a request does not obligate the user to purchase any products or services.

Any subsequent communication, proposal, or agreement occurs directly between the user and the third-party provider.

3.3 Referral and Affiliate Disclosure
If a user independently enters into a contractual agreement with a third-party provider introduced through facilitation services, the Company may receive a referral or facilitation fee from that provider.

The Company is not involved in pricing, negotiation, or contractual terms between the user and the third-party provider and is not a party to any agreement entered into between them.

4. Virtual Design Services
Virtual design services provided through the website are conceptual and advisory in nature. The sole purpose of all virtual design deliverables is to communicate overall layout logic, spatial relationships, and design intent at a conceptual level.

Virtual design deliverables are not architectural plans, construction drawings, shop drawings, fabrication documents, or permit-ready documents. They are not intended to be used for ordering materials, manufacturing products, or executing construction work.

Virtual design deliverables are provided exclusively as a communication and coordination tool to support discussions with executing parties, such as contractors, cabinet fabricators, architects, engineers, or other qualified professionals. These executing parties must independently interpret, adjust, and translate the design intent into their own technical drawings, product specifications, and execution documents, based on verified on-site conditions and their professional judgment.

Executing parties are solely responsible for performing all due diligence necessary to confirm feasibility, accuracy, code compliance, dimensional correctness, and constructability within the actual project conditions. They may not rely on virtual design deliverables as execution-ready documentation or as a substitute for their own measurements, verification, or professional responsibility.

The Company does not verify site dimensions, does not prepare execution-ready documentation, and does not assume responsibility for feasibility, buildability, fabrication accuracy, installation, or construction outcomes. Any work performed based on virtual design deliverables is undertaken at the sole responsibility of the executing parties.

5. Intro Call and Clarity Call Requests
The website allows users to request a free Intro Call or Clarity Call. These calls are exploratory and non-binding and are intended to discuss general goals, project context, and potential next steps related to a possible in-person full kitchen design engagement.
Intro Calls and Clarity Calls are informational in nature. They are intended to allow both parties to determine whether further discussions may be appropriate and whether the scope of a potential project aligns with the services offered. Participation in an Intro Call or Clarity Call does not constitute professional services and does not create any obligation to proceed, engage services, or purchase any offerings.

Information submitted in connection with an Intro Call or Clarity Call is used to schedule and conduct the call and for reasonable follow-up related to the inquiry. Users may opt out of non-essential communications at any time.

6. Separation of Full Kitchen Design and In-Person Services
The Company also offers full kitchen design and in-person design services led by atelier bauherr. These services are not provided through this website and are not governed by these Terms.

Requests for Intro Calls or Clarity Calls are free of charge and do not constitute, initiate, or obligate the user to enter into any paid service. No full kitchen design or in-person services are provided unless and until the user and the Company expressly enter into a separate written agreement governing those services.

Use of the website, including use of the Discovery Room, Virtual Showroom, facilitation services, virtual design services, or participation in an Intro Call or Clarity Call, does not create any obligation, entitlement, or expectation that full kitchen design or in-person services will be provided.

If full kitchen design or in-person services are explored further, they are governed exclusively by a separate written agreement that defines scope, responsibilities, deliverables, fees, and liability. That agreement is provided during service estimation and quotation and is independent from, and not an extension of, these Terms. Nothing in these Terms should be interpreted as modifying, supplementing, or replacing any separate agreement governing full kitchen design or in-person services.
7. No Endorsement and Third-Party Responsibility
The Company does not endorse, recommend, certify, guarantee, or assume responsibility for any third-party products, brands, services, providers, pricing, quality, performance, timelines, or outcomes.

Any references to third-party products, brands, displays, or providers on the website, including within the Discovery Room, Virtual Showroom, blog content, educational materials, or other website pages, are provided solely for informational, comparative, or facilitation purposes. Such references must not be interpreted as endorsements, recommendations, or representations of suitability, quality, or fitness for any particular purpose.

All relationships with third-party providers are entered into directly between the user and the third party. The Company is not a party to any such relationship and assumes no responsibility for third-party information, products, services, or performance. Any reliance on third-party information is undertaken at the user’s sole risk.

8. Intellectual Property
All website content, including but not limited to text, images, visuals, layouts, frameworks, methodologies, tools, guides, and other materials, is the intellectual property of the Company or is used with permission.

Such content is protected by applicable intellectual property laws and may not be copied, reproduced, distributed, modified, displayed, or reused, in whole or in part, without the Company’s prior written consent, except as expressly permitted by law.

9. Limitation of Liability and Assumption of Risk
To the maximum extent permitted by law, the Company assumes no liability arising out of or related to the use of free services, including general website use, blog and editorial content, educational materials, downloads, tools, Discovery Room access, Virtual Showroom access, facilitation services, Intro Calls, or Clarity Calls. All such use is undertaken voluntarily and entirely at the user’s own risk.

The Company does not assume liability for decisions made, actions taken, or outcomes resulting from reliance on informational content, third-party information, or facilitation services provided through the website.
If, and only if, liability is found solely in connection with a paid virtual design service, the Company’s total liability shall be strictly limited to the amount actually paid by the user for that specific virtual design service. No other damages or remedies shall be available.

In no event shall the Company be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including but not limited to loss of use, loss of profits, project delays, cost overruns, construction errors, or third-party performance issues, even if the Company has been advised of the possibility of such damages.

By using the website and related services, the user acknowledges and agrees that the Company is not responsible for execution, construction, fabrication, installation, pricing decisions, or third-party performance and that all such matters remain outside the Company’s scope of responsibility.

10. Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of the State of New York, without regard to conflict-of-law principles.

Any dispute, claim, or action arising out of or relating to these Terms or the use of the website shall be brought exclusively in the state or federal courts located within the State of New York, and the parties expressly consent to the jurisdiction of such courts.

11. Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be enforced to the maximum extent permissible, and the remaining provisions of these Terms shall remain in full force and effect.

12. Updates to These Terms
The Company may revise or update these Terms from time to time. Any changes will be effective upon posting the updated Terms on the website.

Continued access to or use of the website after such updates constitutes acceptance of the revised Terms.
Final Statement
These Terms define the scope, limitations, and boundaries of responsibility for use of the website and the digital, informational, facilitative, and virtual design services provided through it.

By continuing to access or use the website, the user acknowledges that these services are provided on an informational and advisory basis only and that responsibility for verification, execution, and decision-making rests solely with the user and any third parties they engage.

If the user does not agree to these Terms and limitations, the user must discontinue use of the website and all related services.
